“ FORGING” Sworn Public translations is a CRIME

ATP-Rio has been made cognizant that unscrupulous companies and individuals, some established even in other States of the Federative Republic, have been pretending to hold the qualification of public translators, and signing “sworn public translations” with no legal value, resorting even to the inappropriate use of paper with the letterhead and signature of professionals legally qualified

ATP-Rio remarks that, in accordance with the laws in force, since Decree no. 13.609/43, of October 21, 1943, including the Commercial Code, the Civil Procedure Code, the Criminal Code and Law no. 8934/94 (Law of Public Registration of Commercial Companies), only sworn public translators and commercial interpreters, duly registered with the Board of Commerce and bestowed with public faith within the national territory, have the legal attribution of making sworn public translations, under their personal liability.

Any person who is not qualified, but who poses as such, is perpetrating, depending on the circumstances, the crimes foreseen by the Criminal Code, in section 171 (graft), 297 (forgery of public document), 307 or 308 (false identity) and 342 (false practice), incurring in the respective penalties. They shall therefore be liable criminally for the acts committed, besides being liable for civil actions against loss and damage caused, including moral damage.

ATP-Rio warns the public in general that, in view of fake sworn translations, many losses have been caused to corporate entities and individuals, during biddings, judicial actions and other matters.
